Abstract
La presente investigación titulada Nivel de eficacia de la Ley N° 31040 y su afectación del derecho a la salud a consecuencia del alza de precios en las boticas del distrito de Tarapoto, Agosto - Diciembre 2020. Tiene como objetivo general determinar el nivel de eficacia de la Ley N° 31040 y su afectación del derecho a la salud a consecuencia del alza de precios en las boticas del distrito de Tarapoto, Agosto- Diciembre 2020 por lo que se planteó como objetivos específicos en reconocer las dimensiones de la Ley Nº 31040. Ley que modifica el código penal y el código de protección y defensa del consumidor, respecto del acaparamiento, especulación y adulteración; y reconocer las dimensiones del derecho a la salud. La presente investigación fue de tipo aplicada, con nivel correlacional y diseño no experimental, la población estuvo conformado por 400 personas entre pacientes que tuvieron Covid-19, farmacias, boticas e instituciones que están a los alrededores de los centros de asistencia de salud por lo que el muestreo es probabilístico tomando como referencia a 80 personas y el instrumento utilizado fue el cuestionario; concluyendo con el estadístico de correlación de Pearson al 0,719, y un p-valor de 0,000, menor a 0,05, con lo cual se rechaza la hipótesis nula y se afirma que existe relación. Lo cual significa que, el nivel de eficacia de la Ley N° 31040, tiene afectación alta al derecho a la salud a consecuencia del alza de precios en las boticas del distrito de Tarapoto, Agosto- Diciembre 2020.
This is research entitled "Level of effectiveness of Law No. 31040 and its impact on the right to health as a result of the price increase in drugstores in the district of Tarapoto, August - December 2020". Its general objective is to determine the level of effectiveness of Law No. 31040 and its impact on the right to health as a result of price increases in drugstores in the district of Tarapoto, from August to December 2020, therefore, the specific objectives were to recognize the dimensions of Law No. 31040. A law that modifies the penal code and the consumer protection and defense code, with respect to hoarding, speculation and adulteration; and to recognize the dimensions of the right to health. The present research was applied, with correlational level and non-experimental design, the population consisted of 400 people among patients who had Covid-19, pharmacies, drugstores and institutions that are around the health care centers, so the sampling is probabilistic taking 80 people as a reference and the instrument used was the questionnaire. It is concluded that, with Pearson's correlation statistic at 0.719, and a p-value of 0.000, less than 0.05, the null hypothesis is rejected and it is affirmed that there is a relationship. This means that the level of effectiveness of Law No. 31040 has a high impact on the right to health as a result of the price increase in drugstores in the district of Tarapoto, between August and December 2020.
