Abstract
La presente investigación abarca a la Ley del Profesorado - Ley N° 24029, la cual, luego fue reformada por la Ley N° 25212, prescribe en su artículo 48 que el profesor tiene derecho a recibir una bonificación especial mensual por preparación de clases y evaluación equivalente al 30% de su remuneración total; sin embargo, los profesores observaban en sus planillas que percibían la bonificación especial por un monto irrisorio, por debajo del cálculo establecido en la legislación, por ende se ha planteado la siguiente interrogante: ¿Cuál es el nivel de cumplimiento del derecho de bonificación en ejecución de sentencias firmes por preparación de clases, Juzgado Laboral de Tarapoto 2020 - 2021?; originando el siguiente objetivo general de determinar el nivel de cumplimiento del derecho de bonificación en la ejecución de sentencias firmes por preparación de clases, Juzgado Laboral de Tarapoto 2020 – 2021, como objetivos específicos i) Determinar el nivel de vulneración del derecho de bonificación en la ejecución de sentencias firmes por pago de la bonificación especial por preparación de clases y evaluación en el Juzgado Laboral de Tarapoto; y ii) Analizar los factores estructurales de las resoluciones de ejecución de sentencias firmes por pago de la bonificación especial por preparación de clases y evaluación en el Juzgado Laboral de Tarapoto 2020 - 2021. El ámbito de la investigación se encuentra ubicado geográficamente en el distrito de Tarapoto en la sede del Juzgado Transitorio Laboral de Tarapoto, comprendiendo el periodo 2020 - 2021. La metodología empleada fue de tipo Básica con enfoque cuantitativo, nivel descriptivo - correlacional, diseño de investigación no experimental, teniendo como instrumento la lista de cotejo y la guía de análisis documental a resoluciones de sentencias firmes por derecho de bonificación por pago de preparación de clases y evaluación. Como resultado se evidenció que existe un nivel alto del 96% de cumplimiento en la aplicación de las normas del magisterio referente a los procesos de reconocimiento de los derechos laborales, demostrándose que se cumplió en reconocer esa retribución económica a los profesores. Concluyendo que la relación entre el derecho de bonificaciones y el pago de preparación de clases está ligada y vinculada en un 1.45% lo que evidencia el alto cumplimiento y efectivo de las exigencias reclamadas en la vía judicial.
The present research covers the Teacher's Law - Law No. 24029, which was later amended by Law No. 25212. Its Article 48 stipulates that teachers are entitled to receive a special monthly bonus for class preparation and evaluation equivalent to 30% of their total remuneration; however, teachers observed in their pay slips that they received the special bonus for a derisory amount, below the calculation established by law. Therefore, the following question has been raised: What is the level of compliance with the right to a bonus in execution of final judgments for class preparation, in the Tarapoto Labor Court 2020 - 2021? The general objective was to determine the level of compliance with the right to a bonus in the execution of final judgments for class preparation, Labor Court of Tarapoto 2020 - 2021, and the specific objectives were i) To determine the level of violation of the right to a bonus in the execution of final judgments for payment of the special bonus for class preparation and evaluation in the Labor Court of Tarapoto; and ii) To analyze the structural factors of the resolutions of execution of final sentences for payment of the special bonus for class preparation and evaluation in the Labor Court of Tarapoto 2020 - 2021. The scope of the research is geographically located in the district of Tarapoto at the headquarters of the Tarapoto Labor Transitory Court, covering the period 2020 - 2021. The methodology used was basic with a quantitative approach, descriptive-correlational level, non-experimental research design, using a checklist and a documentary analysis guide as instruments for the analysis of resolutions of final sentences for the right to a bonus for payment of class preparation and evaluation. As a result, it was evidenced that there is a high level of 96% compliance in the application of the norms of the teaching profession regarding the processes of recognition of labor rights, demonstrating that the economic retribution of teachers has been recognized. Therefore, it was concluded that the relationship between the right to bonuses and the payment of class preparation is linked and linked in 1.45%, which evidences the high level of compliance and effectiveness of the demands claimed in the judicial process.
