Abstract
A pesar de la importancia de la Ley N°30933 en la protección de los derechos de propiedad y de posesión, se desconoce cuál es su estado situacional, siendo este hecho inquietante porque esta ley fue implementada para suplir las deficiencias de las leyes precedentes de la materia, en torno a su celeridad y efectividad procesal. El objetivo principal de la investigación fue analizar, conocer y describir el estado situacional de la aplicación de la Ley N°30933 en la provincia de San Martín - región San Martín, del año 2021 al 2023, objetivamente. La investigación es de diseño no experimental y transversal, nivel descriptivo simple, enfoque cuantitativo, tipo aplicada, método deductivo. El análisis de los datos cuantitativos se realizó con las tablas de frecuencias detalladas calculadas en Microsoft Excel, recurriendo a la estadística descriptiva. Resultados: se halló que, en la provincia de San Martín, el servicio notarial del procedimiento de desalojo notarial registra 01 proceso de este tipo, el costo del servicio de tres mil soles aproximadamente es considerado caro, y la capacidad de accesibilidad de dicho servicio para los usuarios es muy baja; la preparación de la mayoría de los operadores jurídicos es básica y la mayoría no tiene capacitaciones al respecto; el nivel de gestión arrendataria de los usuarios es bajo; los usuarios no cuentan con condiciones compatibles con el procedimiento especial de desalojo notarial; los usuarios presentan condicionantes de ubicación geográfica, comercial y de costumbre para optar por el servicio notarial, respecto de los distritos que cuentan con oficinas notariales. Concluyéndose que, en la provincia de San Martín: La situación del servicio notarial del procedimiento de desalojo con participación de notario, refleja una evidente inutilización del servicio por parte de los usuarios, debido a que no cuenta con las condiciones aptas ni adecuadas para el uso y accesibilidad al mismo, lo que contribuye a la prominente inaplicación de la Ley N°30933; la preparación de los operadores jurídicos respecto de la Ley N°30933, no es el idóneo, su falta de esfuerzo contribuye a la inaplicación de la ley; la gestión de los usuarios sobre los factores que condicionan la celebración de un contrato de arrendamiento bajo el amparo de la Ley 30933, es baja, es decir, deficiente, lo cual refleja las condiciones incompatibles de los usuarios con el procedimiento y evidencia la desconexión de los legisladores que redactaron la ley con la realidad fáctica de los usuarios; el estado situacional de la aplicación de la Ley N°30933, es desfavorable y, por lo tanto, preocupante en la provincia estudiada, pues los derechos de propiedad y de posesión de los usuarios se están vulnerando.
Despite of the importance of Law N°30933 in the protection of property and possession rights, its status is unknown, being this fact worrisome because this law was implemented to compensate for the deficiencies of the preceding laws on the matter, regarding its speed and procedural effectiveness. The main objective of the research was to analyze, determine and describe the situational status of the application of Law No. 30933 in the province of San Martin - San Martin region, from 2021 to 2023, objectively. The research is of non-experimental and transversal design, simple descriptive level, quantitative approach, applied type, deductive method. The analysis of quantitative data was performed with detailed frequency tables calculated in Microsoft Excel, using descriptive statistics. Results: it was found that, in the province of San Martin, the notarial service of the notarial eviction procedure registers 01 process of this type, the cost of the service of three thousand soles approximately is considered expensive, and the accessibility capacity of such service for the users is very low; the preparation of most of the legal operators is basic and most of them do not have trainings in this regard. The level of tenant management by users is low; users do not have conditions compatible with the special notarial eviction procedure; users have geographical, commercial and customary conditions for opting for the notarial service, compared to districts that have notary offices. It is concluded that, in the province of San Martin: The situation of the notarial service of the eviction procedure with the participation of a notary, reflects an evident disuse of the service by the users, due to the fact that it does not have the suitable or adequate conditions for the use and accessibility to it, which contributes to the prominent inapplication of Law N°30933; the preparation of the legal operators regarding Law N°30933, is not the suitable one, their lack of effort contributes to the inapplication of the law; the management of the users regarding the factors that condition the conclusion of a lease contract under the protection of Law 30933, is low, that is to say, deficient, which reflects the incompatible conditions of the users with the procedure and evidences the disconnection of the legislators who drafted the law with the factual reality of the users; the situational state of the application of Law N°30933, is unfavorable and, therefore, worrisome in the province studied, since the property and possession rights of the users are being violated.
