Abstract
La presente investigación tuvo como objetivo general determinar el nivel de cumplimiento del principio del interés superior del niño en procesos de régimen de visitas en el Primer Juzgado de Familia, Tarapoto, 2020-2023; y, como objetivos específicos: (1) Conocer las dimensiones del principio del interés superior del niño y su aplicación en los procesos de régimen de visitas en el Primer Juzgado de Familia de Tarapoto, 2020-2023; y, (2) Conocer las modalidades del régimen de visitas y su incidencia en el bienestar del niño, niña o adolescente en el Primer Juzgado de Familia de Tarapoto, 2020-2023. Las variables de estudio fueron: principio del interés superior del niño y régimen de visitas. El enfoque de la investigación fue cuantitativo, de tipo básica, nivel descriptivo y diseño no experimental transversal. La población y la muestra lo conformaron 30 sentencias sobre procesos de régimen de visitas dilucidadas ante el Primer Juzgado de Familia de Tarapoto durante los años 2020 al 2023. Se empleó como técnica la observación y como instrumento la lista de cotejo. Los resultados se expresaron en lo siguiente: se conoció que las dimensiones del interés superior del niño aplicados en los procesos de régimen de visitas y las modalidades de estas últimas que incidieron en el bienestar del niño, niña o adolescente en el Primer Juzgado de Familia de Tarapoto durante el periodo 2020-2023, fueron los derechos del niño, el desarrollo integral y la calidad de vida; y, las impuestas con y sin externamiento del hogar donde vive el menor, respectivamente; los cuales no fueron contundentes para asegurar su bienestar y desarrollo integral. Llegando a la conclusión que, el nivel de cumplimiento del principio del interés superior del niño en procesos de régimen de visitas en el Primer Juzgado de Familia, Tarapoto, durante el periodo 2020-2023, fue limitado, con un nivel del 95% de confiabilidad.
The general objective of this investigation was to determine the level of compliance with the principle of the best interests of the child in visitation processes in the First Tarapoto Family Court, 2020-2023; and, as specific objectives: (1) Know the dimensions of the principle of the best interests of the child and its application in the visitation processes in the First Family Court of Tarapoto, 2020-2023; and, (2) Know the modalities of the visitation regime and its impact on the well-being of the child or adolescent in the First Family Court of Tarapoto, 2020-2023. The study variables were: principle of the best interests of the child and visitation regime. The research approach was quantitative, basic, descriptive level and non-experimental cross-sectional design. The population and the sample were made up of 30 sentences on visitation processes elucidated before the First Family Court of Tarapoto during the years 2020 to 2023. Documentary analysis was used as a technique and the documentary analysis guide as an instrument. The results were expressed in the following: it was known that the dimensions of the best interest of the child applied in the visitation processes and the modalities of the latter that affected the well-being of the child or adolescent in the First Family Court of Tarapoto during the period 2020-2023, were the rights of the child, comprehensive development and quality of life; and, those imposed with and without removal from the home where the minor lives, respectively; which were not forceful to ensure their well-being and comprehensive development. Coming to the conclusion that the level of compliance with the principle of the best interests of the child in visitation processes in the First Tarapoto Family Court, during the period 2020-2023, was limited, with a level of 95% reliability.
