Abstract
Afectación del interés superior del niño y adolescente en el régimen de visitas durante el COVID-19, Tarapoto 2020-2021
Es importante resaltar que en el año 1989 se desarrolló un evento histórico que es la ratificación de la Convención Internacional sobre los Derechos del Niño (CIDN) que vino a ser más que todo, el término de un procedimiento evolutivo de reconocer y proteger los derechos de los más vulnerables, nos referimos a los niños, todo esto en el siglo XX. Se señala como problema general: ¿Cómo se evidencia la Afectación del interés superior del niño y adolescente en el régimen de visitas durante el COVID-19, Tarapoto 2020-2021? Asimismo como objetivo general: Determinar la Afectación del interés superior del niño y adolescente en el régimen de visitas durante el COVID-19, Tarapoto 2020-2021 y objetivos específicos: (1) Reconocer las dimensiones del interés superior del niño (2) Identificar las características del régimen de visitas en niños y adolescentes durante el COVID-19 y como hipótesis de investigación: La Afectación del interés superior del niño y adolescente en el régimen de visitas durante el COVID-19, Tarapoto 2020-2021 ES MEDIA. Los intereses del niño se definen de tal manera que todas las decisiones relativas al niño o adolescente deben estar encaminadas a sus intereses y al pleno ejercicio de sus derechos. Asimismo, es importante señalar que aquel padre que producto de la separación de hecho o divorcio, que no cuente con la tenencia de su o sus menores hijos, tiene el derecho reconocido por la norma, de solicitar un régimen de visitas en cualquier momento, a fin de poder también compartir momentos juntos. La investigación es de diseño descriptivo simple, donde concluye; que se evidencia la existencia de un agravio en contra del interés superior del niño y adolescente, en el régimen de visitas se evidenció de sobremanera toda vez que el factor confinamiento fue un impedimento para el desarrollo del menor como tal.
Affectation of the child's and adolescent's best interest in the visitation regime during COVID-19, Tarapoto 2020-2021. It is important to mention that in 1989 a historic event took place, the ratification of the International Convention on the Rights of the Child (ICRC), which became more than anything else, the end of an evolutionary procedure to recognize and protect the rights of the most vulnerable, namely children, all this in the twentieth century. The general problem is: How is the Affectation of the best interest of the child and adolescent in the visitation regime during the COVID-19, Tarapoto 2020-2021? The general objective was: To determine the impact on the best interests of children and adolescents in the visitation regime during COVID-19, Tarapoto 2020-2021 and specific objectives: (1) To recognize the dimensions of the best interests of the child (2) To identify the characteristics of the visitation regime in children and adolescents during COVID-19. As research hypotheses: The Affectation of the best interests of the child and adolescent in the visitation regime during COVID-19, Tarapoto 2020-2021 IS MEDIUM. The interests of the child are defined in such a way that all decisions relating to the child or adolescent must be aimed at his or her interests and the full exercise of his or her rights. Likewise, it is important to point out that the parent who, as a result of the de facto separation or divorce, does not have custody of his or her minor children, has the right recognized by the law, to request a visitation regime at any time, in order to be able to share moments together. The research is of a simple descriptive design. It concludes that the existence of a violation of the best interests of the child and adolescent is evident in the visitation regime, since the confinement factor was an impediment to the development of the child as such.
