Reforma procesal para establecer competencia penal para el juez de paz letrado en delito de omisión a la asistencia familiar

Abstract

La presente investigación titulada: reforma procesal para establecer competencia penal para el juez de paz letrado en delitos de omisión a la asistencia familiar, la cual tiene como objetivo general proponer una ley que otorgue competencia penal al Juez de Paz Letrado con el objetivo que pueda conocer los delitos de Omisión a la Asistencia Familiar y como objetivos específicos: (1) Describir cuál es el tratamiento procesal del delito de Omisión a la Asistencia Familiar en las leyes vigentes y (2) Describir cuál sería la reforma procesal para otorgar la competencia penal al Juez de Paz Letrado para que pueda conocer los delitos de Omisión a la Asistencia Familiar; La metodología adoptada en esta investigación se caracteriza por ser de tipo básico y de enfoque cualitativo, empleando un diseño de teoría fundamentada. Para llevar a cabo el proceso de investigación, se utilizarán métodos exegéticos, dogmáticos y sociológicos. En el procedimiento, se tomará en consideración la opinión de diferentes actores del sistema judicial, incluyendo 5 magistrados con experiencia en cargos como juez de paz letrado, juez de investigación preparatoria y juez penal unipersonal, así como 5 fiscales y 5 docentes universitarios. Para recolectar los datos necesarios, se emplearán dos instrumentos: la ficha de registro y la guía de entrevista. Como resultado de este estudio, se propone otorgar competencia penal al Juez de Paz Letrado para los delitos de omisión de asistencia familiar, con el objetivo de simplificar y agilizar el tratamiento de estos casos, y mejorar la protección de los menores involucrados. Un análisis de la normativa actual revela la complejidad y la prolongación de los procesos judiciales, lo que repercute negativamente en los beneficiarios. La inclusión del enfoque conciliador del Juez de Paz Letrado, junto con la posibilidad de aplicar principios de oportunidad y acuerdos reparatorios, busca promover una justicia más eficiente. Para implementar esta reforma, se propone modificar la Ley Orgánica del Poder Judicial y el Código Procesal Penal, además de capacitar a los jueces en materia penal, con el fin de garantizar una administración de justicia más rápida y equitativa.

The present investigation entitled: procedural reform to establish criminal jurisdiction for the learned justice of the peace in crimes of omission of family assistance, which has the general objective of proposing a law that grants criminal jurisdiction to the learned justice of the peace with the objective that he can know the crimes of Omission of Family Assistance and as specific objectives: (1) Describe the procedural treatment of the crime of Omission of Family Assistance in current laws and (2) Describe what the procedural reform would be to grant criminal jurisdiction to the Legal Justice of the Peace so that he can hear the crimes of Omission of Family Assistance; The methodology adopted in this research is characterized by being basic and qualitative in approach, using a grounded theory design. To carry out the research process, exegetical, dogmatic and sociological methods will be used. In the procedure, the opinion of different actors in the judicial system will be taken into consideration, including 5 magistrates with experience in positions such as a legal justice of the peace, a preparatory investigation judge and a single-person criminal judge, as well as 5 prosecutors and 5 university professors. To collect the necessary data, two instruments will be used: the registration form and the interview guide. As a result of this study, it is proposed to grant criminal jurisdiction to the Legal Justice of the Peace for crimes of omission of family assistance, with the aim of simplifying and expediting the treatment of these cases, and improving the protection of the minors involved. An analysis of current regulations reveals the complexity and length of judicial processes, which has a negative impact on beneficiaries. The inclusion of the conciliatory approach of the Legal Justice of the Peace, together with the possibility of applying principles of opportunity and reparatory agreements, seeks to promote more efficient justice. To implement this reform, it is proposed to modify the Organic Law of the Judiciary and the Criminal Procedure Code, in addition to training judges in criminal matters, in order to guarantee a faster and more equitable administration of justice.
