Abstract
El presente trabajo de investigación titulado “Eficacia del proceso único de ejecución de obligación de dar suma de dinero, en el Segundo Juzgado Civil – Tarapoto, 2021”; tiene como objetivo general, determinar su eficacia y objetivo específico, determinar su nivel de eficacia en todas sus dimensiones, en los aspectos doctrinarios, jurisprudenciales y legales; considerando que el ejecutante en la sede jurisdiccional busca satisfacer la obligación pendiente de cumplimiento que el ejecutado tiene a su favor, avalando su pretensión en mérito a un título de ejecución, de calidad judicial o extrajudicial, que debe poseer un contenido cierto, expreso, exigible y líquido, y cuyo trámite se realizará conforme al Código Civil, Código Procesal Civil y el Sexto Pleno Casatorio Civil. En esta investigación la metodología a emplearse es de tipo Básica – Cuantitativa, nivel Descriptivo – Básica, de diseño No experimental – Descriptivo, teniendo la población que equivale a 59 expedientes judiciales en ejecución de la referida materia, esto es, de aquellos expedientes que emitieron decisión de primera instancia en el año 2021, cuya muestra equivale a la misma cantidad de expedientes, utilizando como técnica el análisis documental y el instrumento de guía de análisis documental. Asimismo, la referida metodología permitirá el desarrollo del presente trabajo y determinar que su eficacia es baja, por lo que se vulnera el derecho a acceder a una causa que garantice el debido proceso y la tutela jurisdiccional efectiva. En ese sentido, de los resultados obtenidos y de acuerdo a la hipótesis de investigación planteada, esto es, que la eficacia es baja, ha sido validada, al verificarse que tiene relación con los resultados.
The present research work is entitled “Effectiveness of the single process of execution of the obligation to give a sum of money, in the Second Civil Court - Tarapoto, 2021”. Its general objective is to determine its effectiveness and specific objective, to determine its level of effectiveness in all its dimensions, in doctrinal, jurisprudential and legal aspects, considering that the executor in the jurisdictional venue aims to satisfy the pending obligation that the executed party has in its favor, endorsing its claim based on a title of execution, of judicial or extrajudicial quality, which must have a certain, express, enforceable and liquid content, and whose processing will be carried out in accordance with the Civil Code, Code of Civil Procedure and the Sixth Plenary Civil Cassation. In this research, the methodology used is Basic - Quantitative, with a Descriptive - Basic level and a Non-experimental - Descriptive design. The population consists of 59 judicial files in execution of the referred matter, that is, those files that issued a first instance decision during the year 2021, whose sample is equivalent to the same number of files, using documentary analysis and the documentary analysis guide instrument as a technique. Likewise, the referred methodology will allow the development of the present work and determine that its effectiveness is low, thus violating the right to access a case that guarantees due process and effective jurisdictional protection. In this sense, from the results obtained and in accordance with the research hypothesis, namely that efficacy is low, it has been validated, as it has been verified that it is related to the results.
