Abstract
El delito de omisión a la asistencia familiar representa uno de los delitos con mayor incidencia a nivel nacional y si bien es cierto la aplicación del principio de oportunidad intenta reducir la carga procesal, los menores alimentistas siguen desprotegidos al no evidenciarse la satisfacción en el pago de las pensiones alimentistas dentro de un plazo razonable. Siendo así, se planteó como objetivo general: determinar el nivel de cumplimiento del principio de oportunidad en delitos de omisión a la asistencia familiar en la Segunda Fiscalía Penal Corporativa de Tarapoto, 2021; asimismo, como objetivos específicos: i) Cuantificar el número de casos que cumplieron los acuerdos de principio de oportunidad en los delitos de omisión familiar a la asistencia familiar en la Segunda Fiscalía Penal Corporativa de Tarapoto, 2021; y, ii) Identificar el grado de cumplimiento que existe en los agraviados de los delitos de omisión a la asistencia familiar en la Segunda Fiscalía Penal Corporativa de Tarapoto, 2021. La investigación fue de tipo básica con un enfoque cuantitativo, diseño de investigación no experimental y nivel descriptivo simple. Los instrumentos utilizados fueron una guía de cotejo para el análisis de las 30 carpetas fiscales y un cuestionario dirigido a 30 agraviados. De esa manera se concluyó que el nivel de cumplimiento del principio de oportunidad en los delitos de omisión a la asistencia familiar en la Segunda Fiscalía Penal Corporativa de Tarapoto durante el año 2021 fue mayoritariamente alto, con un 57%; además, el análisis estadístico realizado evidenció una correlación alta y significativa entre las variables, explicando un 38.44% de la variabilidad, lo que subraya su relevancia como herramienta para garantizar el interés superior del menor y el debido proceso. En consecuencia, se recomienda que al momento de arribar a un principio de oportunidad los fraccionamientos de la obligación alimentaria se realicen en plazos cortos que permitan al menor alimentista recuperar su calidad de vida y así evitar vulneraciones a sus derechos fundamentales.
The crime of failure to provide family support represents one of the most prevalent crimes nationwide. While the application of the opportunity principle attempts to reduce the procedural burden, minors seeking support remain unprotected as there is no evidence of satisfaction with the payment of child support payments within a reasonable period. Therefore, the general objective was to determine the level of compliance with the opportunity principle in crimes of failure to provide family support in the Second Corporate Criminal Prosecutor's Office of Tarapoto, 2021; and the specific objectives were: i) to quantify the number of cases that complied with the opportunity principle agreements in crimes of failure to provide family support in the Second Corporate Criminal Prosecutor's Office of Tarapoto, 2021; and ii) to identify the degree of compliance among aggrieved parties in crimes of failure to provide family support in the Second Corporate Criminal Prosecutor's Office of Tarapoto, 2021. The research was basic in nature, with a quantitative approach, a non-experimental research design, and a simple descriptive level. The instruments used were a comparison guide for the analysis of the 30 tax files and a questionnaire addressed to 30 aggrieved parties. It was concluded that the level of compliance with the opportunity principle in crimes of failure to provide family support in the Second Corporate Criminal Prosecutor's Office of Tarapoto during 2021 was mostly high, at 57%. Furthermore, the statistical analysis showed a high and significant correlation between the variables, explaining 38.44% of the variability, which underscores its relevance as a tool to guarantee the best interests of the minor and due process. Consequently, it is recommended that when reaching the opportunity principle, the payment of child support obligations be carried out in short periods of time, allowing the minor receiving support to recover their quality of life and thus avoid violations of their fundamental rights.
