Abstract
La investigación tiene como título “Relación del Derecho a la Sindicalización y la Negociación Colectiva en trabajadores de empresas privadas, Tarapoto 2021-2022”, que se origina motivada por la importancia de estos derechos laborales fundamentales y las barreras para su ejercicio efectivo. Para ello se planteó el siguiente objetivo general: Determinar la relación del derecho a la sindicalización y la negociación colectiva en trabajadores de empresas privadas- Tarapoto 2021-2022. Presenta una metodología de tipo aplicada, enfoque cuantitativo, nivel descriptivo-correlacional y diseño no experimental; empleando el instrumento de cuestionario aplicado a 145 trabajadores de 4 empresas comerciales (Bitel Tarapoto, Botica La Inmaculada, Supermercado La Inmaculada y Caja Maynas). Los resultados revelaron que el 53.8% de los trabajadores cree que la negociación colectiva podría mejorar sus condiciones laborales, pero el 62.8% nunca ha intentado negociar, indicando barreras en la práctica. Aunque hay un alto cumplimiento de beneficios laborales básicos, existe insatisfacción salarial en un 30.34% de los trabajadores. Concluyendo la existencia de una relación positiva, alta y significativa entre el derecho a la sindicalización y la negociación colectiva, con un coeficiente de determinación del 45.42%, esto refuerza la importancia de ambos derechos como fundamentales y estrechamente interconectados en el ámbito laboral, respaldando teorías previas y destacando la necesidad de garantizar su pleno ejercicio. No obstante, la identificación de otros factores que influyen en esta dinámica sugiere la necesidad de futuras investigaciones para una comprensión más integral.
The research is entitled “Relationship of the Right to Unionization and Collective Bargaining in workers of private companies, Tarapoto 2021-2022”, which is motivated by the importance of these fundamental labor rights and the barriers to their effective exercise. For this purpose, the following general objective was set: To determine the relationship between the right to unionization and collective bargaining in workers of private companies - Tarapoto 2021-2022. It presents a methodology of applied type, quantitative approach, descriptive-correlational level and non-experimental design; using the questionnaire instrument applied to 145 workers of 4 commercial companies (Bitel Tarapoto, Botica La Inmaculada, Supermercado La Inmaculada y Caja Maynas). The results revealed that 53.8% of the workers believe that collective bargaining could improve their working conditions, but 62.8% have never tried to negotiate, indicating barriers in practice. Although there is high compliance with basic labor benefits, there is wage dissatisfaction in 30.34% of the workers. It is concluded that there is a positive, high and significant relationship between the right to unionization and collective bargaining, with a coefficient of determination of 45.42%, which reinforces the importance of both rights as fundamental and closely interconnected in the labor sphere, supporting previous theories and highlighting the need to guarantee their full exercise. However, the identification of other factors influencing this dynamic suggests the need for future research for a more comprehensive understanding.
